These terms explain what this website is, what it is not, and the rules that apply when you use it or contact us through it. Please read them before using the site.

1. Who we are

This website is operated by Uptown Java Coffee & Bar ("Uptown Java," "we," "us," "our"), a coffee shop and wine bar located at 2627 N 205th St, Elkhorn, NE 68022, United States. You can reach us at (813) 497-0533 or alexpersonalprivate07@gmail.com.

By using this website you agree to these Terms of Use, our Privacy Policy, our Cookie Policy and our Refund Policy. If you do not agree, please do not use the site.

2. What this website is

This site is informational only. It exists to show our menu, our hours and how to find us.

• We do not sell anything through this website.
• We do not take online orders or online payments here.
• We do not take table reservations through this website.
• Nothing on this site is a binding offer. All food, drink and service is sold in person at the café.

The only information you can send us through this site is a message using our contact form, and only if you choose to.

3. Menu, prices and availability

We work hard to keep the menu and prices on this site accurate, but they can change at any time without notice. Items may sell out, change seasonally or be unavailable on a given day. Photographs are of our own food and drink, taken at the café, and are illustrative — the plate you receive may differ in presentation.

If a price shown on this site is different from the price at the café, the price at the café applies. We reserve the right to correct errors on this site at any time.

Prices shown do not include sales tax or gratuity unless stated.

5. Alcohol service

We serve wine and other alcoholic beverages in the evening under a Nebraska liquor license. By law and by house policy:

• You must be 21 years of age or older to purchase or consume alcohol.
• We may ask any guest for a valid, government-issued photo ID, and we may refuse service if we cannot verify age.
• We may refuse or discontinue alcohol service to any guest at our discretion, including any guest who appears intoxicated. This is required of us as a licensee.
• No alcohol may be removed from the premises except as permitted by law.

Nothing on this site is intended to be seen by, or to appeal to, anyone under 21. We never advertise free, unlimited or unlimited-time alcohol service.

6. Private room, events and catering inquiries

Our private room and catering pages describe what we can do, but they are not a booking. An event, private-room reservation or catering order exists only once we have confirmed it with you in writing (email or a signed event form) and you have paid any deposit we ask for.

Guest counts, menus, timing and pricing are agreed case by case. Deposits, changes and cancellations are governed by our Refund Policy and by the written confirmation we send you. Where the two differ, the written confirmation for your event controls.

7. Gift cards

Gift cards are sold at the café and are redeemable for food and drink at the café. Gift cards are not refundable or redeemable for cash except where state law requires it, and we are not able to replace a lost or stolen card without proof of purchase. Treat a gift card like cash. 8. Our content

The text, layout, design, logo, name "Uptown Java Coffee & Bar," menu descriptions and photographs on this site belong to us or are used by us with permission. All photographs of our food, drinks, room and service were taken by or for Uptown Java.

You may link to this site and share our pages. You may not copy, republish, sell or use our content, our name or our logo for your own commercial purposes, and you may not use our content to imply that we endorse you, without our written permission.

If you believe any material on this site infringes your rights, email alexpersonalprivate07@gmail.com with a description of the material and where it appears, and we will review and remove it if appropriate.

9. Acceptable use

When you use this site, you agree not to:

• submit false, misleading or abusive information through the contact form, or submit someone else's personal information without their permission;
• use the contact form to send advertising, spam or chain messages;
• attempt to gain unauthorized access to the site, its host or any related system;
• scrape, harvest or automatically collect content or data from the site;
• interfere with the normal operation of the site or use it for any unlawful purpose.

10. Links to other sites

This site links to places we do not control, such as Google Maps and our social media pages. Those services have their own terms and privacy practices, and we are not responsible for their content, availability or how they handle your information.

11. No warranties

This website is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free, secure or free of harmful components, or that the information on it is complete or current at any given moment.

This section does not limit any warranty that applies to food and beverages you actually purchase from us under applicable law, and it does not limit any right you have that cannot be waived under Nebraska law.

12. Limitation of liability

To the fullest extent permitted by law, Uptown Java and its owners, managers and employees will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, loss of goodwill or business interruption, arising out of or relating to your use of this website — even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability arising out of or relating to this website will not exceed one hundred U.S. dollars ($100.00) or the amount you paid us through this website (which is zero, because we take no payments here), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you. Nothing in these terms excludes liability for fraud, willful misconduct, personal injury or death to the extent that liability cannot be excluded by law.

13. Indemnification

You agree to defend, indemnify and hold harmless Uptown Java and its owners, managers and employees from any claims, damages, losses and reasonable attorneys' fees that arise out of your misuse of this website or your breach of these Terms of Use.

14. Accessibility

We want this site to work for everyone. It is built to follow the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA as closely as we can, using readable contrast, text alternatives for images, keyboard-reachable controls and a layout that works on a phone.

15. Changes to these terms

We may update these terms as our business changes. The version in force is the one posted on this page, with the "last updated" date at the top. Using the site after a change means you accept the updated terms. Material changes to our Refund Policy will not be applied retroactively to an event or catering order we have already confirmed in writing.

16. Governing law and where disputes are heard

These terms are governed by the laws of the State of Nebraska, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to this website or these terms will be brought exclusively in the state or federal courts located in Douglas County, Nebraska, and you and we consent to the jurisdiction of those courts.

Before filing anything, please contact us. Almost everything is fixable with a phone call.

17. Other terms

If any provision of these terms is found unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the Privacy, Cookie and Refund policies, are the entire agreement between you and us regarding this website.
